Albert Einstein, an incredible scientist once stated to â€Å"not judge a fish by its ability to climb a tree†. Yet, in our education system we â€Å"judge† every student’s ability to function at a four-year university daily. When taking an exam we are all given the same aptitude exams, university standards or even the notorious EPT/ELM exam for a CSU. Having the same exam diminishes the idea of a specialty being shown through oneself. In our world today, we have many individuals with a variety of specialties contributing to the creation of a society. Many successful people have careers in a field that requires only knowledge in what they work in and the fundamentals of the requisites they may have. Teachers or parents might argue how early start†¦show more content†¦The accuracy of the EPT/ELM exam might be accurate in what shows on the scantron, but not what the student really specializes in or knows. Like an athlete getting a scholarship to a school, every student should have the potential of being admitted to a school for what they are best at. With the idea of having every student meet the same guidelines, a university will never meet its full potential because of the lack of originality in the students. The Early Start program is based off these assumptions of a student s potential; which is why the program should be abolished or have it running for students as an option. Some may argue that if the student was accepted to the university, it must imply the student has a specialty. Truth of the matter is that 50% of students go in undeclared or end up changing the intended major; which can only portray how the student does not know what they are best at or what they have a passion for. Students today are focused solely on meeting the numbers, guidelines and standards, that they forget why they go to school in the first place; to get a career they love. In addition to not having the student’s specialty shine, the amount o f time given at an Early Start program is by far too short for students to actually learn. Their extreme unchecked emotions act as a driving force, defining their actions as well as motivations and this is very powerfully portrayed when we hear Catherine’s own words through Nellie’s rather trivial narration, when it comes to one another as seen, when Cathy says, ‘†¦my great thought in living is himself. If all else perished, and he remained, I should still continue to be; and if all else remained, and he were annihilated, the universe would turn into a mighty stranger: I should not seem a part of it.’ Where Bell creates such a powerful picture of the idea of ‘love,’ Bronte’s novel is more of an unconventional but idealised fantasy of it. It is a story about Jane’s quest to find love and a sense of belonging whilst simultaneously struggling to maintain a balance between passion and logic. Characterisation is used to position readers to see this, as when Jane provides Rochester with a voice of reason, suggesting that opposing the divine power in exchange for passion will never make him happy, ‘You will degenerate †¦I may get [happiness] as sweet and fresh as the wild honey the bees gather on the moor †¦ [but]it will taste bitter, Sir.’ Both texts share similar themes, however, Bronte and Bell conclude their novels with contrasting conclusions which despite their differences, successfully evoke appropriate emotions from the reader and achieve one of the purposes regarding the defeat of social norms. Wuthering Heights unfolds as Heathcliff’s irrepressible love towards Catherine eventually dissolves his inner conflict and numbs his longing for revenge upon his oppressors offsprings as he nears death. Hareton and Cathy’s marriage indicates the dawn of a new era, further strengthening the fact that true love is capable of overcoming any sort of hardship. On the contrary, Jane Eyre verifies the saying, ‘All good things come to those who wait,’ as Jane restores peace in her life by being happily married to Rochester who has gained some of his sight back, after battling to repress her romanticism and the Victorian society realism. The ending provides clarity to the theme of love and social standing whilst freeing Jane from society’s restraints. Undoubtedly, the purpose of each texts is to entertain their respective audiences. Both authors rely on the use of a combination of literary and stylistic techniques to convey their ideas to a well-educated audience. They also cleverly incorporate symbolism of nature, which was particularly popular with the more learned middle classes during the 19th century. Such symbolism can be recognised in Bell’s characterisation when she writes, ‘Catherine’s face was just like the landscape—shadows and sunshine flitting over it†¦but the shadows rested longer, and the sunshine was more transient,’ and in Bronte’s when she uses fire and ice to symbolise Jane’s independence in the face of the restrictions of society as ‘a ridge of lighted heath, alive, glancing and devouring.’ However, Bronte makes more use of this technique as compared to Bell, in order to foreshadow events that are meant to unfold as the plot unravels, for instance, the chestnut tree being struck by lightning under which Rochester proposes to Jane which foreshadows the misfortune that is to follow. Both the authors also associate setting to each of their protagonists. The first 19th century setting, Wuthering Heights, symbolises humanity’s dark side, which is reinforced by its constant comparison to the bleak winter time and the location’s dark and diabolical illustration whereas Thrushcross Grange is described as the summer time, portraying an artificial utopia whilst mirroring its respective inhabitants, something only a well-educated, thinking reader would understand. However in Jane Eyre, each setting symbolises the character’s development and conflicting circumstances throughout the story. Each text is intended to appeal to the initial audience of the Victorian era, a time when Romantics placed great emphasis upon nature and human emotion, as seen in Wuthering Heights. On the other hand, Jane and Rochester’s relationship is based on mutual respect, something that rarely existed during the 19th century. Bronte’s targeted audience also believed that the role of a woman is only to give birth and to please her spouse. Both novels are meant for a well-read audience, especially Bell’s, as the reader must be intellectually capable of comprehending the complicated emotions of the characters, and the complex and distinctive writing style of each author. The plot is appropriate for both genders, however, a female audience could potentially be more inclined to empathize with and recognise Catherine and Jane’s emotions as well as the whole theme of ‘love’ when compared to men. Both novels possess a unique and sophisticated narrative structure that enables the reader to interpret the story, once the tone and context have been acknowledged. Catherine also uses the metaphor of ‘eternal rocks’ to describe her love for Heathcliff, her one true love, as never-changing and powerful, whereas her love for Edgar, her spouse, is ‘like the foliage in the wood.’ This suggests that similar to the way in which foliage changes, her feelings towards him do too. In contrast, Bronte makes it evident through the use of personification, that Jane and Rochester’s relationship thrives on the basis of true love; a bond that unifies them as true love is meant to, in contrast to Catherine and Heathcliff’s situation where they yearn for a sense of fulfillment. Wuthering Heights relates to anger and violence, represented by its murky and turbulent climate similar to its inhabitants, whereas Thrushcross Grange personifies civility and warmth. Jane Eyre also illustrates a valid image of the Victorian era and its social footing of its time. It signifies the effects of class consciousness and demonstrates the deprecative demeanor certain lower classes would receive at the expense of egotistical elites. An example of such behaviour is when John Reed repeatedly reminds Jane of her ‘worthless’ orphan status that leaves her dependant upon his family. Mnemonic Devices Absorb & Relate #5 & 6 Absorb: When talking about memory in this chapter, metacognition and metamemory are introduced. Metacognition is our awareness of and knowledge about our own cognitive system. In other words, this is referred to as ?knowing about knowing.? Metamemroy is the knowldege about one's own memory system; also known as ?knowing how to know.? One's metamemroy process includes the awareness that you must get ?things? into the memory by performing some intentional acitivity. This intentional mental acitivity is known as rehearsal. Mnemonic means ?to help the memory.? As the textbook states, a mnemonic device is an active, strategic kind of learning device or method, otherwise known as a rehearsal strategy. Each mnemonic device is either formal, meaning you learn the mnemonic ?scheme? and then apply it, or informal, which is when you invent the scheme yourself. Informal devices are characterized by three principles: 1) the material being learned is structured and integrated into a preexisting memory framework. 2) The material to be remembered must be practiced. 3) The mnemonic device provides a plan or scheme for retrieving information. Mnemonic devices provide an easier way to remember information. People use them to remember specific items in a shorter, quicker way than memorizing the entire concept. There are two types of mnemonic devies in which the book discuesses. The first one is the method of loci. Two active ingredients are invloed in this method; the first being the memorized physical locations and the second being the mental images of the to-be-remembered items. An example of this would be the grocery list that we did in class. It worked very well because each grocery item that we associated with locations was easty to remember. The other is the peg-word mnemonic device. This is where a prememorized set of words serves as a sequence of metnal ?pegs? onto which the to-be-remmeberd matersial can be ?hung.? For example, rhymes help to remember the items necessary. All mnemonic devices are helpful, whthery they are invented by yourself or not. Each of them rely on the three principles previously mentioned. If you take the method of loci device, for example, each principle applies to it. It clearly provides a structure for learning because you are consciously attempting to memorize items within a certain structure. The material is practiced because you are visually picturing items with the locations and repeating that to yourself so you can remember it. And lastly, this device privdes a scheme so that one can retrieve the information being stored in the memory. Because of the method used, one can later retrive this inforamtion fairly easy. Introduction Qatar has a well-developed and structured legal system. The origin of the Qatar legal system is found in both ancient and traditional sources. It is based on Islamic law and jurisprudence but has adopted many of the principles of the Napoleonic Civil Code (French Civil Code). In addition, Egyptian philosophy of law and procedure (Egyptian Civil Code) had a great influence on the legal and judicial system of Qatar. The State of Qatar is a traditional country ruled by Al-Thani family and the state leadership being inherited by Al-Thani family since mid-19th century Qatar’s judicial history was influenced by a series of events beginning with the Ottoman occupation of the region in the 19th century. As stated in Background to legal system in Qatar by Qatar Law website â€Å"The Ottoman rulers established a system of justice based on teachings of the Hanafi school of Islamic Law. As the Ottoman Empire started to lose its grip on its rule in Qatar and elsewhere in the Arabian Gulf, Qatar underwent a gradual shift towards the Hanbali school of Islamic Law under the influence of the then emerging regional power, Saudi Arabia† (Partners, 2014). Qatar became a protectorate of Britain after the 1916 treaty and British legal system was established formally after the treaty. The civil courts established by British enforced English laws albeit local courts continued to administer a legal system based on Sharia law (Islamic law) which was the legal system in pre British era. This practice created a dual court system that existed until recent time in Qatar. Modern Qatar legislative process began in 1961, when Law No. 1 for the year 1961 was issued. Subsequently, several modern legislations covering the administrative, economic and social activities were enacted. Qatar passed the new Judicial Law No. 10 for the year 2003 in October 2003 which revolutionized and unified the judicial system in Qatar. This law became effective in October 2004. Qatar enacted a new Civil Law in 2004, providing applicability in respect of limitation of time and territorial jurisdiction. Other important definitions such as of natural and juridical persons principles and legal capacity to sue and be sued were incorporated in to the new Civil Law. Contractual relationships in construction sector were codified as Law No. (22) of 2004 with the passing of Qatar Civil Law. Law No. (22) of 2004 Promulgating the Civil Code was issued by H/H Hamad Bin Khalifa Al Thani, Emir of Qatar exercising the executive authority vested under the Constitution. As stated in Qatar Law website â€Å"Qatar Civil Code provides guidelines for the establishment of contractual relations and obligations arising therefrom. It specifies basic elements of a contract such as consent, subject matter, and purpose of contracting. It also deals with annulment, construction and binding nature, effect, and cancellation of contracts† (Partners, 2014). The UAE federation comprising seven Emirates namely; Abu Dhabi, Dubai, Sharjah, Ras Al Khaimah, Umm Al Quwain, Ajman and Fujairah was established on 02nd of December 1971. The Constitution declares the Sharia is the principal source for law in the UAE and a civil law jurisdiction heavily influenced by the Egyptian law system which was heavily influenced by French and Roman law. Commercial transactions are governed by UAE Federal Commercial Transactions Law ‘Commercial Code’ (No. 18 of 1993). Civil transactions are governed by UAE Law of Civil Transactions ‘Civil Code’ (No. 5 of 1985 No. 1 of 1987) (Whelan, 2011). In the absence of any specific provisions in Civil Code , the Islamic Sharia law will be applied. In matters of procedure, the UAE courts follow the Federal Civil Procedure Law ‘Civil Procedure Code’ (No. 11 of 1992 as amended). Articles 872 to 896 of the UAE Civil Law 1987 (the Civil Law) relating to construction works, as well as general maxims and principles set out in the same law, form the basis of the legal framework relating to construction. Also, UAE Commercial Transactions Law provisions would apply to the degree that the parties to a construction claim could be defined as traders conducting commercial business as per Articles 6 and 11. The general principle of freedom and sanctity of contract is recognized under the Qatar Civil Code and a contract is treated as the law of the contracting parties. Natural and legal persons are free to agree on whatever they desire, provided that their agreement does not conflict with law, public order and morality. Verbal contracts and contracts as a result of conduct of the parties are mostly recognized and are enforceable in court subjected to establishing / proving the contractual-relationship. The Civil Law also deals with interpretation of contracts, contractual responsibilities, liability for personal acts, and responsibility for acts of third parties, ownership responsibilities, surety, unjust enrichment, types of sale, lease, insurance, and rights attached to property, land law, mortgage, wills, legacy, privileges, and gains. It also stipulates performance, compensation and compulsory execution, assignment of rights, innovation and impossibility of performance and statutes of limitation. Contractors are often faced with employer- driven Omission, Suspension Termination of the Construction Contracts due to financial constraints and other difficulties encountered by Clients and Contractors in Qatar Middle East in general. Medium to large scale public works projects procured by Public Works Authority of Qatar (Ashghal) use General Conditions of Qatar (its own spoke form) published by Contracts Engineering Business Affairs (CEBA) which were updated and reissued on July 2007 prepared by either in-house lawyers or external law firms. The Qatar General Conditions of Qatar is a close resemblance of International Federation of Consulting Engineers (FIDIC) Yellow, Silver or Red Book contracts. The other major projects procured by state affiliated organizations such as Qatar Foundation, Qatar Gas, RasGas, Qatar Water Electricity board (Kharamaa), New Doha Aiprt Steering Committee use their own bespoke and â€Å"project specific† forms. Where a project is awarded on a lump sum basis, the 2007 General Conditions of Contract favoured by employers in Qatar places much of the risk for losses on the contractor, except where losses are adequately covered under the amended provisions to the Contract. A reasonably fair assessment of the General Conditions of Contract by many contractors in Qatar is that it heavily favours the employer. While this may be the case, a contractor may also be entitled to claim equitable relief in accordance with the Qatar Civil Law No. 22 of 2004. In the above scenario, it is imperative to analyze the rights and entitlements of Clients Contractors in circumstances arising from Omission, Suspension Termination of the Construction Contracts under FIDIC 1987 revision 4 FIDIC 1999 which are base documents for most of the Bespoke Conditions of Contracts in Qatar and its enforcement under the Civil Law of Qatar U.A.E. 2. Aim Analyze the legal aspects of Omission, Suspension Termination of the Construction Contracts under the Qatar U.A.E Civil Law. 3. Objectives There are four objectives of this study: To identify the limit of a Contractors’ exposure to the Employer in respect of Omission, Suspension Termination of the Construction Contracts. To identify the limit of Employer’s exposure to the Contractor. Analyze the entitlements between FIDIC suit of Contracts and Qatar U.A.E. Civil Code To determine reasonable solutions and precautions. 4. Research methodology The following Literature was reviewed during the initially to ascertain the feasibility of conducting a comprehensive research on the subject dissertation. Binding Force of a Contract – Article 171of Law No. 22 of 2004 – Qatar Civil Code â€Å"A contract is the law of the contracting parties, and it may not be revoked or amended, except by agreement of both parties or for prescribed by the law† (Portal, 2014). Dissolution of a Contract Article 183of Law No. 22 of 2004 – Qatar Civil Code Article 183 states that â€Å"In contracts binding on both parties and imposing reciprocal obligations (synallagmatic contracts), where one of the parties fails to perform his obligation, the other party may, upon formal notice to the former, demand performance of the contract or its rescission, and may claim any damages caused by such failure to perform† (Portal, 2014). â€Å"The judge may,mutatis mutandis, determine a period of grace within which the obligor shall perform his obligation. The judge may also reject the application for rescission if the obligation not performed is insignificant compared with the obligations considered in their entirety† (Portal, 2014). Termination of a Contract of Works under Articles 703, 704 707 of Law No. 22 of 2004 – Qatar Civil Code Termination of a Contract under Articles 892 893 of UAE Federal Law No. 2/87 – The Civil Code Dissolution of a Contract under Articles 185 188 of Law No. 22 of 2004 – Qatar Civil Code Article 185 states that â€Å"When a contract is rescinded, the contracting parties shall be reinstated to the position they were in prior to the date of the conclusion of the contract. If reinstatement is impossible, the court may grant indemnity† (Portal, 2014). Article 188 states that; â€Å"The contracting parties may mutually agree to terminate the contract upon its conclusion, provided that the subject matter of the contract remains in the possession of either party. Where the subject matter of the contract is lost, damaged or disposed of in part in favour of a third party, the contract may be rescinded to the extent of the remaining part and the share of the party† (Portal, 2014) Dissolution of a Contract under Article 273 of UAE Federal Law No. 2/87 – The Civil Code Dissolution of a Contract under Articles 267 268 of UAE Federal Law No. 2/87 – The Civil Code The binding force of a Contract under Article 172 of Law No. 22 of 2004 – Qatar Civil Code The effect of the Contract under Article 246 of UAE Federal Law No. 2/87 – The Civil Code Ruling issued for the year 2006 by Court of Cassation, Dubai Literature study and analytical research are my major learning methods which play an important role in this report. Analytical research involves analyzing existing case law, facts and information. The data will be collected from primary/secondary sources, interviews with industry experts and case studies/laws. Literature study and analytical research have been chosen due to complex laws of the country and its interpretation by the Law experts. However, any analysis contained in this dissertation is the author’s own opinion and shall not be construed as evidence in a court of law. This paper does not have any legal or contractual standing in interpreting a binding Contract Document. 5. Scope and Limitation The building construction contracts stipulate express provisions governing the rights of one or both parties to terminate the contract under certain circumstances. These express provisions are categorized as non-contractual rights and contractual rights to terminate a binding contract. The Non-contractual rights to terminate are defined as; Frustration and this occurs when circumstances rather than the default of contracting parties have intervened to prevent the contract being performed as intended originally. When frustration occurs, further performance of the contract is impossible, illegal or radically changed from what the parties contemplated at the time of signing the contract. The contract is automatically terminated once a frustration event occurs and the parties are absolved from further obligations but accrued liabilities remain with them. The party who is relying on frustration provisions in the contract must be sure of that a frustration event actually occurred when justifying the ceasing of operations under the contract to avoid being in breach (the contract is more expensive to perform is not a frustrating event). It is prudent that the events stipulated under force majeure clauses should not overlap with the frustration events and the events which are provided their consequences are stated in the contra cts shall also not be considered as frustrating events. It is imperative to define Force Majeure events in the contract and clause 19.1 of FIDIC 1999 First Edition state that the definition of â€Å"Force Majeure† as; â€Å"Means an exceptional event or circumstance: (a) which is beyond a Party’s control, (b) which such Party could not reasonably have provided against before entering into the Contract, (c) which, having arisen, such Party could not reasonably have avoided or overcome, and (d) which is not substantially attributable to the other Party† (FIDIC, 1999). Force Majeure events are exceptional events or circumstances as listed FIDIC 1999 below and those satisfy the clause 19.1 of FIDIC 1999 sub-clause (a) to (d) above: â€Å"(i) war, hostilities (whether war be declared or not), invasion, act of foreign enemies, (ii) rebellion, terrorism, revolution, insurrection, military or usurped power, or civil war, (iii) riot, commotion, disorder, strike or lockout by persons other than the Contractor’s Personnel and other employees of the Contractor and Subcontractors, (iv) munitions of war, explosive materials, ionising radiation or contamination by radio-activity, except as may be attributable to the Contractor’s use of such munitions, explosives, radiation or radio-activity, and (v) natural catastrophes such as earthquake, hurricane, typhoon or volcanic activity† (FIDIC, 1999). Repudiation and this occurs when a party to the contract commits a serious breach of contract that entitles the innocent party to consider the contract as terminated with immediate effect and sue for damages due to breach of the contract. The following will be considered as clear repudiation of a construction contract Contractor’s refusal to carry out contract scope; Vacant the site or un-authorized removal of plant by the contractor; Procuring other contractors to carry out the whole or part of the scope of work originally contracted; Employer’s failure to give access to the site (possession of the site). The Contractual rights to terminate are classified as; Termination for Cause and the clauses stipulated in the contract vesting powers/rights to terminate the contract for breaches of specified contractual obligations such as unjustified/ unrecoverable delays attributed non-performance of the works. The parties may exercise their rights to terminate in other circumstances too, such as occurrence of a force majeure event. Termination for Convenience or ‘at will’ clauses may be incorporated in to construction contract vesting powers to one party to terminate the contract without having to establish any cause or breach for termination for the other party. This clause is very useful in the event that the; the employer changes the use of the land (eg. Condominium development to a hotel development) the employer’s inability to secure financing for the whole project or secure anchor tenants the contractor finds the project will be unprofitable or too risky the project has been suspended for a prolong period with no prospect of it being recommenced. There is a very close relationship between suspension and termination and, depending on how the clause is drafted. The end result of a suspension clause may be much the same as a termination clause in that either party will have the right to terminate the contract at the end of the agreed suspension period. The justification for suspension clauses will be broadly similar to termination such as a change of circumstances on the ground that makes continuing with the works impossible in the short term. Notwithstanding the above, suspension may be used by one party to allow it space to consider how to proceed with a project, which should be acceptable to the other party if kept within bounds. The scope of this research is to identify the legal provisions to secure the rights and entitlements provided under Qatar Civil Code and UAE Federal Law in Omissions, Suspensions and Terminations and limited to the construction contracts under the jurisdiction of the subject countries. The main limitation is the Language. The Qatar and UAE Laws are written in Arabic and official translation in English language is not available. The author relies on many unofficial translations of Qatar and UAE Laws for the purpose of this research. Arabic language prevails over the any launage in a Court of Law in Qatar and UAE. 6. The Contractors (and the Employers) as the case shall be able to seek the solace of Law even if the Contract Agreement they entered in to is heavily bias towards the Employer as the Law of land prevails over any contractual relationship between parties. 7. Grasshoppers are herbivorous insects of the suborder Caelifera in the order Orthoptera. To distinguish them from bush crickets or katydids, they are sometimes referred to as short-horn grasshoppers. Species that change colour and behaviour at high population densities are called locusts. The Characteristics of a Grasshopper The Grasshoppers have antennae that are almost always shorter than the body (sometime filamentous), and short ovipositors. These species that make easily heard noise usually do so by rubbing the hind femurs against the forewings or abdomen (stridulation), or by snapping the wing sin flight. Tympana, if present, are on the sides of the first abdominal segment. The hind femora are typically long and strong fitted for leaping. Generally they are winged, but hind winds are membranous while front wings (tegmina) are coriaceous and not fit for flight. Females are normally larger than males, with short ovipositors. They are easily confused with the other sub-order of Orthoptera Ensifea, but are different in many aspects, such as the segments in their antennae and structure of the ovipositor, as well as Ensiferans have antennae with at least 30 segments and Caelifera have fewer. In evolutionary terms, the spilt between the Caelifera and the Ensifera is no more recent than the Permo-Triassic boundary (Zeuner 1939) Their Diverstiry and range Recent estimates (Kevan 1982, GÃ ¼nther, 1980, 1992, Otte 1994-1995 subsequent literature) indicate some 2,400 valid Caeliferan Genera and about 11,000 valid species described to date. It is alarming how more and more violent acts are being done by young students these days. A lot of factors can influence them and can be blamed but still there are not enough programs or ways to stop these acts. Everyone, including the media, community, and government, should be involved in this situation because these young people do not realize the graveness and seriousness of their outrages. There is an interrelation between preventing violence and resolving conflict (Johnson & Johnson, 1995, p. 5). This is seen with Project Schools Teaching Options for Peace (S. T. O. P) and The Safe Harbor Program. The former is a conflict resolution program while the latter deals with anti-violence. The two programs produced positive results in that it gave students the opportunity to change with regard to the way they see things. It gave them the chance to talk about what they were dealing and to resolve their conflicts. It made them understand themselves better, as well as to understand their environment and the people that surrounds them better. It made them feel that they are not alone and that there is help when they need it. Young adults or teenagers have a lot on their minds that most older people do not understand. At times, these young people are misunderstood and, therefore, ignored. The problem is, when they are ignored, it is the time when they would probably do things that they would soon regret. This is the reason why it is important that programs that would provide help and support should always be available especially to students. Human Performance Technology Model Essay The journal I had chosen is â€Å"Minding the gap , identifying performances issues using the Human Performances Technology model (HPT) . † The purpose of this journal is to main a useful model for identifying and addressing employee performance issues in academic libraries , specifically in a Learning Commons . As we know , assessing and improving employee performance , especially library services are always challenging . However , HPT provides methods for evaluating human performances , such as the performance of employees at a service point , and , and provides method in fixing problems that are identified . Most of the time , training is always assumed solution for many performances issues , but HPT suggests that the training is not always the answer and provides a variety of the other solutions referred to intervention . The HPT model created by the International Society for Performance Improvement (ISPI , 2010 a ) was used to evaluate employee performance at the service point in a newly created Learning Commons . Various interventions are also discussed the address performances issues in libraries. The HPT model may help librarians create measurable performance indicators which can be used to set standard of performances for employees. This model is useful for a combination of student workers, paraprofessionals and librarians. The HPT model comes from field of HPT , which is the combination of education , psychology and business . So , HPT is the process of identifying and analyzing the gap between current performances ( where one is ) and ideal performance ( where one wants to be ) using various tools such as models . Closing the gap can be done through a recommend solution called an intervention. â€Å"Intervention† in HPT refers to a course of action taken to improve performance . Each stage of the HPT process helps one understand the behaviors of people in an organization and of the organization as a whole . HPT aims to analyze observable behaviour both individually and collectively. HPT ensures a through of a variety of areas within an organization in order to understand the performance gap. An analysis of values, norms, culture, structure, performance, and environment is recommended . Through an organization analysis , environmental analysis , gap analysis , can cause those who using HPT analysis determine the performance problem or opportunity . Without careful analysis , inappropriate intervention could be implemented . Intervention should be long term , evolutionary and progressive. Learning Commons in Randall Library at the University of North Carolina Wilmington (UNCW ) was using HPT model to evaluate employee performance. The Learning Commons provides a variety of hardware and software, a centralized service point is included in the middle of the Learning Commons. This service point staffed by librarians who are full time faculty members at UNCW and university’s Technology Assistance Center (TAC) student assistant who are hired to work part time at multiple service points , including the Learning Commons service point , in Randall Library . The primary user group of the Learning Commons is UNCW students . The learning Commons applied HPT after three months opens . The performances issues identified after three months after opening . While some performance issues may ‘work themselves out ‘ overtime , if using the HPT model early in the operation can identify the problems immediately and prevents the problems . Application of the model can helps to identify the root of the causes and helps pinpoint appropriate solution for those issues. An assumption that training is always the appropriate solution for all performances problems can be corrected using HPT . As noted in the HPT model , there are several phases of analysis which are performance analysis , organizational analysis , environmental analysis , gap analysis and cause analysis . A â€Å"cause analysis† follows the performance analysis helps to identify a â€Å"lack of environmental support† or a â€Å"lack of repertory behaviour†. â€Å"Intervention selection ,design , and development† follow all analysis phases . That is because after identify all the gaps or problems , then only can select the appropriate intervention to fix the problem . Main Body and Discussion Human Performance Technology (HPT ) is a systematic approach to improving productivity and competence , it is a strategy for solving problems and for realizing opportunities related to the performance of people . It uses a wide range of intervention to improve individual and organizational performance . There are three fundamental processes to go through . There are performance analysis ,cause analysis and intervention selection . It can be applied to individuals , small groups ,and large organizations . Without identified the causes of the issues , the appropriate intervention impossible to created . Learning Commons in Randall Library at the University of North Carolina Wilmington (UNCW) was using HPT model to evaluate employee performance at the service point . First stage of the HPT model calls performance analysis . The â€Å"performance analysis† is to determine if a performance problem exists . A performance analysis includes an organizational analysis , an environmental analysis ,and a gap analysis . The first step in the performance analysis , the organizational analysis , calls for an examination of an organization ‘s vision , mission , values ,goals and strategies . It is important to define the boundaries of the organization before performing this phase in the model . It is useful to examine all departments or offices that closely related to the specific area under examination. The next component of HPT model is environmental analysis . The environmental analysis examines four important factors which are organizational environment, work environment, work, and the worker. In the HPT model, the â€Å"Work Environment† refers to the â€Å"resources, tools, human resources, and policies† of an organization, or in this case, of the Learning Commons. â€Å"Work† is described as â€Å"work flow, procedure, responsibilities, and ergonomics†. â€Å"Worker† refers to the â€Å"knowledge , skill , motivation , expectation and capacity† of an individual . The â€Å"Gap analysis† requires an examination of the actual performance versus the optimal , or desired performance . The information collected through the organizational and environmental analysis . The HPT model shows that the gap falls between the â€Å"Desired workforce performance† and the â€Å"Actual state of workforce performance†. It is important to identify the gaps , then analyze the causes of those gap happens. In Learning Commons , there has a temporary service desk was constructed , new furniture was not yet installed and a formal staff training program was not yet implemented . The performances of Learning Commons service was not optimal and causes a â€Å"gap† between optimal and desired performances . Next is causes analysis . As the HPT model suggests , after the performances gap was identified ,the â€Å"cause analysis† should be completed . The cause analysis can determine why the performance gap exists . Once a cause is identified, one or more interventions can be selected that will be able to close the performance gap . There are some causes for the performances issues . First , data , information and feedback . Initial training and communication of clear roles , responsibilities and expectations were not provided when the Learning Commons initially opened . Second , environment support , resources and tools . Detailed in Learning Commons employee did not exist . The conflict among workers will be happened . Third , consequences , incentives , reward . There were no consequences , incentives or rewards related to performance at the Learning Commons service point . Forth , skill and knowledge . A deficiency in general knowledge of the library services and the role of the librarians at the service point existed among TAC student assistants . Fifth , motivation and expectations . It is unclear what motivates Learning Commons employees and what they expect from themselves . After knowing the causes of the issues , intervention selection , design and development is needed . Closing the performances gap can be done through recommended solutions called interventions. HPT suggests that training is not always the appropriate solution because training will not solve issues related to motivation and expectation . However , an incentives and rewards will address motivation . There are some interventions existed after knowing the causes . There are job description intervention , document and standards intervention , training intervention , performance appraisal intervention . A job description specifically for employment in the Learning Commons would define each position’s duties , responsibilities , working conditions , and job activities , which would help employees understand their own job and the role of the other employees at the Learning Commons services point . Besides that , to remedy problems related to lack of information for job duties and procedures , the recommendation is a documents and standards intervention . The standard operating procedures(SOP) manual would include the job description , expectations , policies , guidelines , and procedures for each position at the service desk . Training intervention is training librarians and TAC students . Training employees would provide expectations for each employee . Performance appraisal intervention show staff that there will be consequences for poor performance and rewards for good performance . On the other hand , feedback should be encouraged in Learning Commons . Positive feedback should be provided and given from all the employees . Negative feedback is also important to correct everyday issues . After implemented all the intervention that suggested, must evaluate their success based on further analysis of performance . In my opinion , HPT is a very good tool to evaluate the individual performance or organizational performance . As we see the problems in Learning Commons , HPT had given a good solution for it in fixing the problem . HPT begins with a comparison of the of the present and the desired levels of individual and organizational performance to identify the performance gap. Once the performance gap and the causes have been determined, the appropriate interventions are designed and developed. These may include measurement and feedback systems, new tools and equipment, compensation and reward systems, selection and placement of employees, and training and development. The interventions are then implemented and the change process managed. After implemented all the intervention , The employees in Learning Commons will clear about their roles , responsibilities . At the same time , The Learning Commons is already providing to be a great resource at UNCW . HPT model must be applied cyclically and systematically over time to evaluate employee performance . However , I do not agree that HPT is always the best tool in solving problem . This is because it might identify wrong data or information during performance analysis . If it is wrong in the beginning of the process , inappropriate intervention might created . This will make the decision maker make the wrong decision . While doing wrong analysis , there might insert a high cost and it’s will be a waste of time if the analysis is wrong . Moreover , HPT has mentioned a few intervention to fix the problems . It’s hard to implement all those intervention at the same time . If cannot implement successfully , the more problem might exists . But if whole process is running smoothly , nonetheless , HPT is a very tool in solving problem . I had compared two models which are HPT model and ADDIE model . The ADDIE model is a systematic instructional design model consisting of five phase which are analysis , design , development ,implementation and evaluation phase . There are a few similarities between HPT model and ADDIE model . They both use process of analysis to look the problem and seek for the solution as well . However , they have a key different between the model . The ADDIE model addresses the â€Å"gaps between desired outcomes or behaviours and the audience’s existing knowledge and skills†. The ADDIE models mainly focus on the individual needs and then design and develop objectives and processes help the individual . Evaluation and implementation do not just happened at the end of the design and development . They are ongoing to inform the designer . So if there any changes, the necessary solution can be made quickly . The HPT model is different because it more focus on the causes of â€Å"performance† gap . The success of the organization is depend on its employees . HPT will look what causes the employees unable to perform the job . HPT’s goal is to increase the bottom line of the company by increasing the individual’s ability to perform the job . In addition , it is important that the HPT is look â€Å" what caused the problem† ,while the ADDIE model looks at â€Å" solving the problem exists † . HPT model design seem to also behaviourist approach because the focus is more changing individual behaviour . The HPT model will look at evaluation of the problem and how it was addressed long after the process . The HPT model has its own advantages . In my view , because HPT model is focused on how the people perform on the job . In my opinion , the workers or the people of the organization is the assets for its organization . So , the performance of the individual affect overall success of the organization . This model takes many variables into the account , that there will affect performance . It humanizes the work place because the individuals are allowed to address their problems. At the same time , it may be necessary to provide training course if the individual unable to perform the work is because of lacking information or unknowledgeable . Beside that , HPT model never ignore the reward or motivation . If they have a good performance , incentive or reward will be given to motivate the employees . Every model has its own disadvantages as well , disadvantage I see is how the technologist ensures lifelong working and the successful using the collected information. Because they wait a while before evaluating. It would seem to me that the worker would want to know immediately if they are doing better so that changes can be made more quickly. Feedback is so important to workers feeling successful and competent. If there is too much focus on negative feedback, it may have a negative impact on the individual. Where as in the ADDIE model, the worker’s deficiencies or the causes problems are not the major focus, and you get feedback at various stages rather than only at the end of the process. If I were a human resource professional in any area , I would use HPT model . As I was also a worker before , I see that would be beneficial for all the subordinates or primary worker . If workers feel supported, they’ll do better than if they’re not supported. It provides a guide to helping individuals be successful in their work. I think someone who feels successful and competent in their work is more likely to suffer less burn out than those individuals who have no one in their corner to mentor or help them solve whatever issue is keeping them from doing their best on the job. I might also use HPT when talking to friends or children about getting jobs and being successful on the job. I can apply it to my own career and be my own trouble shooter as well as look for solutions. This puts a little more power over what I do in my hands because at least I would know that I can change me to help the organization do its job better too. On the other hand , as I mentioned employees are a part of assets of the organization . I think it is the responsibility of the human resource department to choose an appropriate system of performance appraisal . Effective appraisal system motivate the employees all the time rather than joining training . Conclusion In conclusion, HPT model has been described as the systematic and systemic identification and removal of barriers to individual and organizational performance. Nonetheless ,HPT model is an effective tool for uncovering performance issues . The model can be applied to any area in the library where employees must perform and is not limited to public service . In any new service , some performance issues may â€Å" work themselves out† overtime while some may not . In some cases , problems left unidentified or unsolved , it may be quite difficult to fix after an extended period of time . It is same like our daily habit or problems , if a parent identified that a child is beginning to pick up a bad habit , it is certainly easier to change the child’s behaviour when the parent first notices their child’s behaviour . If the parents did not take action to stop their child in the beginning , it is hard to stop their child after maintain a long bad habit . Similarity to any other service , if identify the problems early , then can find out the causes and fix it as fast as possible . The model does require extensive analysis . Without this analysis , a full picture cannot be taken , assumption will be made , and issues or problems cannot be identified . Optimal employee performance is critical in any organization . From the journal , Learning Commons in UNCW is using human performance technology (HPT ) . It is a library . With libraries needing to demonstrate their value and provide assessment data and administration . The HPT model serves as one more useful tool for libraries to accomplish this . I had read a journal , which is about ADDIE model and I had also compared both ADDIE and HPT model . I found that there have many similarities . But when I go deeper for the journal , I found that there is a big differences . ADDIE model focus more on training building program , while in HPT model , training is only one of the tool . HPT model is not only useful in organization , but also useful for every individual . If did not find out the causes properly , a appropriate solution is impossible to created .

(DH 2001), defined mental health as ‘thinking, feeling and physical health and well-being‘. The world Health Organisation (WHO), (2001) defines health as ‘a state of complete physical, mental and social well-being and not merely the absence of disease or infirmity. Mental health problems are more common in people with a learning disability which is the authors chosen branch of work. It is important to have a good knowledge about what health is before defining what mental health is. The WHO uses a holistic approach when looking at health. The (2004) WHO report on â€Å"Promoting Mental Health† stated that â€Å".mental Health and mental illness are determined by multiple and interacting social, Psychological and biological factors, just as health and illness in general. Mental health implies fitness rather than freedom from illness† (WHO, 2004 p 13). Norman and Ryrie, (2009) are not in full agreement of WHOS definitions of health and mental health. They suggest that, these definitions are little value. However they are in agreement with their 2007 definitions and suggest that it hold more promise. They suggest it relates more to their quadrant concept of ‘self and ‘community. Norman and Ryrie are in the agreement with the WHOS definition they believe it is slightly complex and they suggest that, the authors Keyes (2002) and Huppert (2005) use more simpler approach to defined positive   mental health and well-being. The use terms such as hedonic and eudaimonic.Hedonic means positive feelings and positive affect, which reflect subjective well-being and eudaimonic means positive fu nctioning, which includes engagement, fulfilment and social well-being. Mental health is the capacity to live life to the full in ways that enables us to realise our own natural potentialities, and that unite us with rather than divide us from all other human beings who make up our world (Guntrip 1964).According to the Department of Health (1995), mental health consists of four key capacities: The ability to develop psychologically, emotionally, intellectually and spiritually, the ability to intiate, develop and sustain mutually satisfying personal relationships, the ability to become aware of others and to empathise with them and the ability to use psychological distress as a development process, so that it does not hinder or impair further development. Depression REFLECTION Schon, (1983) define reflection as a process of thinking with a purpose and focused strongly on the need to test out and challenge true beliefs by applying the scientific method through deductive reasoning and experimentation and also implied that emotions and feelings are part of reflective thinking. Reflection is an active persistent and careful consideration of any belief or supposed form of knowledge in the light of the grounds that support it and the further conclusion to which it tends Dewey (1933).Using Gibbs reflective Cycle, (1988) appendix 1 and Neil Flemings Vark system, (1987) I will reflect on my experiences on my practise ward and on my theory. By having the chance to completed Flemings Vark questionnaire and my result was multimodal. This showed that I could learn by reading and writing literature, learning using visual aids, aurally and using kinaesthetic methods. I intend to reflect on my communication skills, literacy skills IT skills using Gibbs cycle. Gibbs cycle is a six stage cycle which helps the reader to reflect on situations, analyse feelings and evaluate experiences, conclude situations and how a person would deal with experiences again if they rose.
